Georgina advises on a broad range of landlord and tenant issues and has particular expertise in respect of business tenancy renewals and the Electronic Communications Code. In the residential space, she deals with various property management issues for landlord clients and has extensive experience of proceedings in the Leasehold Valuation Tribunal. Georgina also advises on other real property issues including restrictive covenants, misrepresentation and rights of light issues.
Georgina sits on the Cambridge University Land Society Commercial Property Forum and is a member of the Training and Education Committee of The Property Litigation Association.
Georgina is admitted to practise in England and Wales.
Experience
- Acting for a joint venture partnership in proceedings in the High Court seeking a rights of light injunction against a neighbouring developer. The case involved numerous contested interim applications and hearings. The trial was set to review all aspects of the law of rights of light and settled shortly before trial. (Adjoin Ltd v Fortytwo House Sarl [2022] EWHC 2710 (Ch))
- Advising the Church Commissioners in an application to determine the apportionment of garden rates under an Estate Management Scheme. (Chelwood House Freehold Company Limited v. The Church Commissioners for England (2022)).
- Achieved success (both at first instance and on an application for permission to appeal) for a landlord client in opposing the grant of a renewal lease to Santander, on the basis of a proposed redevelopment (Santander UK plc v LCP Estates Limited [2018] EWHC 2193 (Ch)).
- Successfully defended an application under section 84 of the LPA 1925 by a long leasehold tenant who sought to vary its lease user restrictions. The decision in Edgware Road (2015) Limited v. Church Commissioners for England [2020] UKUT 0104 (LC) preserved the Church Commissioners’ ability to control the management of their estate. An application for permission to appeal was refused.
- Secured vacant possession of a rooftop of a block of flats in Wembley against a number of telecoms operators, to allow the block to be sold for redevelopment. Our strategic advice led to the successful conclusion of possession proceedings and a short-term Code agreement for the temporary relocation of the apparatus.
