The Financial Times and BBC quote Andrew Ross on a Supreme Court judgment affecting water companies and private landowners
Water companies could now face legal challenges following a landmark judgement from the Supreme Court in Manchester Ship Canal Company v. United Utilities Water Ltd.
The court has ruled that private landowners and individuals may have rights to claim against them for sewage released into UK waterways. The legal challenge was one of a number faced by water companies and the government as anger mounts over the mixture of storm water and raw sewage that is pouring into rivers and coastal waters, threatening human and environmental health.
Commenting on the judgment, Andrew Ross, Partner in our Real Estate Disputes team, was quoted by the Financial Times and BBC:
Owners of waterways may now consider taking action against sewerage undertakers for polluting water, and it is very possible that we could now see an increase in this type of legal claim.
